초록

현재 우리나라에는 「스포츠기본법」이 제정되어 시행 중이다. 동법 제2조는 이 법의 기본이념으로서 ‘이 법은 국민 모두가 스포츠 및 신체활동에 자유롭고 평등하게 참여하여 건강하고 행복한 삶을 영위할 수 있도록 스포츠의 가치가 교육, 문화, 환경, 인권, 복지, 정치, 경제, 여가 등 우리 사회 영역 전반에 확산될 수 있게 국가와 지방자치단체가 그 역할을 다하며, 개인이 스포츠 활동에서 차별받지 아니하도록 하고, 스포츠의 다양성, 자율성과 민주성의 원리가 조화롭게 실현되도록 하는 것을 기본이념으로 한다.’고 규정하고 있다. 과거에는 스포츠활동을 한다는 것이 국민 개개인이 선수로서 참여하는 것을 주된 논의대상으로 하고 있었다. 하지만, 최근에는 생활체육의 확대 등으로 인해, 국민 개개인이 스포츠활동에 참가함에 있어 심판, 지도자 등 스포츠와 관련한 다양한 역할을 수행하게 되었다.
본 연구는 위 기본이념과 관련하여 특히 ‘개인이 스포츠 활동에서 차별받지 않아야 한다’는 ‘차별금지와 기회균등의 보장’의 관점을 연구의 주제로 한다. 이러한 연구를 수행함에 있어서 ‘농구의 경기통계 기록원의 자격요건’을 중심으로 검토하기로 한다. 연구방법으로서 농구 이외에 우리나라에서 주요 구기종목으로 언급되는 배구, 야구, 축구에서의 관련 논의를 살펴보고, 우리나라와 법체계가 유사한 일본의 관련 제도를 살펴보기로 한다.
이를 통해 현재 농구경기에 있어서의 심판과 경기기록원에 대한 문제점 및 개선방안을 제시하면 다음과 같다. 첫째, 일본과의 비교법적 검토를 행한 결과, 우리나라에서는 심판과 경기기록원의 자격취득과 관련하여 예외가 더욱 많이 마련되어 있다고 보여진다. 이러한 예외는 일반적인 승급 혹은 승격제도를 이용하는 국민과 비교할 때, 특정인에 대한 편의 혹은 특혜로 작동해서는 안 될 것이다.
둘째, 경기기록원의 연령에 따른 차별취급이 발생할 여지가 있다는 점이다. ‘대한민국농구협회 경기원 자격 및 교육규정’ 제4조 제4항은 경기원의 활동연령은 만 60세까지로 한다고 명시적으로 규정하고 있음에도 불구하고, 교육에 대한 공지에 있어서 만 40세 이하로 한다는 자격요건을 발견할 수 있다. 연령제한규정으로 인해 스포츠활동에 참가하는 기회가 박탈당하는 국민이 생겨서는 안 될 것이다. 그리고 이러한 내용은 상위규정에 위반하는 내용으로서 그 효력을 인정할 수 없다고 보아야 할 것이다.
이러한 문제점에 대한 개선안으로서는 입법적 논의보다는 스포츠행정의 집행단계에서 관련 논의를 면밀하게 검토하는 것이 중요하다고 생각한다. 즉, 현재 협회의 개별 교육이나 강습을 행함에 있어 제규정들을 잘 준수하고 있는지에 대한 모니터링이 중요할 것이다. 결국 이러한 논의들의 바탕에는 「스포츠기본법」의 기본이념이 자리잡고 있는 것이다. 이러한 기본이념이 단순한 확인적 규정에 그치지 않고, 개별 스포츠활동에서 그 취지를 발휘하도록 법적으로 검토하는 차원에서 본 연구를 수행한 것이다. 「스포츠기본법」의 기본이념과 개별 스포츠행정이 별도로 논의되는 것이 아니라, 하나의 연장선상에서 논의되어 보다 일관성 및 통일성을 도모한 스포츠행정이 행해지기를 기대한다.

영어초록

Sports Basic Law has been enacted and implemented in Korea now. The basic ideology of Article 2 is to ensure that the value of sports can spread throughout our society, including education, culture, environment, human rights, welfare, politics, economy, and leisure, and to ensure that individuals are not discriminated against in sports activities, autonomy and democracy. In the past, sports activities were the main subject of discussion for individual citizens to participate as athletes. However, due to the recent expansion of sports for all, individual citizens have played various roles related to sports such as referees and leaders in participating in sports activities.
This study focuses on the perspective of “guarantee of discrimination and equal opportunity” that “individuals should not be discriminated against in sports activities.” In conducting such a study, it will be reviewed focusing on the 'qualification requirements of the basketball game statistics recorder'. As a research method, we will look at related discussions in volleyball, baseball, and soccer, which are mentioned as major ball games in Korea in addition to basketball, and look at related systems in Japan, which have similar legal systems to Korea.
Summarizing the contents of this study can be summarized as follows. First, as a result of a comparative legal review with Japan, it seems that there are more exceptions in Korea regarding the acquisition of qualifications for referees and Score keepers. Compared to the people who use the general promotion or promotion system, the exceptionally recognized qualification conditions should not work as convenience or preferential treatment for a specific person.
Second, there is posibility for discrimination according to the age of the Score keepers. Although Article 4 (4) of the Korea Basketball Association's Qualification and Education Regulations explicitly stipulates that the age of Score keepers is up to 60 years old, it is possible to find a qualification requirement to be under 40 years old in notification of education. No people should be deprived of opportunities to participate in sports activities due to age restrictions. In addition, it should be considered that this content violates the higher law and its effect cannot be recognized.
As an improvement plan for these problems, it is considered important to closely review related discussions at the execution stage of sports administration rather than legislative discussions. In other words, it will be important to monitor whether the association is currently complying with the regulations in conducting individual education or classes.
It is expected that the contents reviewed in this study will be revised as a system reflecting the purpose of the Sports Basic Law. Through this, I hope that sports administration will be carried out more effectively. In the end, the basic ideology of Sports Basic Law lies on the basis of these discussions. This study was conducted in order to legally review this basic ideology not only to be a simple confirmatory regulation, but to exert its purpose in individual sports activities. It is hoped that the basic principles of the Sports Basic Law and individual sports administration will not be discussed separately, but that sports administration will be discussed as an extension to promote more consistency and unity.
