공해상 선박충돌사고 등의 형사관할권에 관한 소고: 어니스트 헤밍웨이호 사건을 중심으로 (A Study on the Penal Jurisdiction of the Vessel Collision Accidents on the High Seas: Focusing on the M/V Earnest Hemingway Case)

초록

UN해양법협약 제97조 제1항은 공해상 선박의 충돌사고 또는 선박에 관련된 그 밖의 항행사고가 발생한 경우에 선장 또는 그 선박에 근무하는 관련자에 대한 형사책임이나 징계책임은 그 선박의 기국이나 관련자의 국적국 외에는 제기될 수 없다고 규정하고 있다. 이에 공해에서 발생한 모든 선박충돌사고 등의 사건에 동 규정을 적용한다면 가해 자는 보호받을 수 있지만 피해자의 권익 보호는 매우 제한될 수밖에 없다. 특히, 가해선 박이 사고 후 아무런 구호조치를 취하지 않고 현장을 이탈하여 피해자가 사망에 이르게 되었다면 이는 결코 가볍게 넘어갈 수 없는 범죄이다.
일부 국가에서는 소극적 속인주의를 적용하여 공해상에서 발행한 사고로 자국민이 피해를 입은 경우 형사관할권을 적극적으로 행사하려는 움직임을 보이고 있다.
그러나 우리나라의 경우는 아직 형사관할권을 적극적으로 해석하여 형법 제6조를 적용한 판례를 찾기가 쉽지 않다.
따라서 이 논문에서는 UN해양법 협약 제97조 제1항의 입법배경과 형사관할권의 이론적 근거를 살펴보고, 특히 어니스트 헤밍웨이호 사건에 대한 검찰의 기소의견과 법원의 판결을 통하여 우리나라 형사관할권의 확장 가능성에 대하여 의견을 제시해 보고자 한다. 이를 통해, 우리의 국민의 보호나 주권의 수호를 위한 형사관할권의 적극적 행사가 필요함을 주장하고자 한다.

영어초록

In accordance with the provisions of Article 97, paragraph 1 of the United Nations Convention on the Law of the Sea, 1982, in the event of a collision or any other incident of navigation concerning a ship on the high seas involving the penal or disciplinary responsibility of the master or of any other person in the service of the ship, no penal or disciplinary proceedings may be instituted against the person except before the judicial or administrative authorities either of the flag State or of the State of which the person is a national. Thus, if the provisions of Article 97, paragraph 1 is applied to a collision or any other incident of navigation concerning a ship on the high seas, the victims’ right of the collision or incident would not be properly protected and guarded whereas the offender may relatively be protected well in a sense.
Especially, when ships collide each other, if the offender ship leaves without taking any measures necessary to rescue human lives and ships, and if consequently the victims dies, such situation can not be easily ignored.
In some countries, they are willing to exercise their penal jurisdiction positively to the incident concerning a ship on the high seas result in injuries of their people through applying a passive personality principle. But it is difficult to find a case applying the Criminal Act Article 6 in relation with the incident concerning a ship on the high seas by means of positively interpreting penal jurisdiction yet.
Thus, this study examines the background information on Article 97, paragraph 1 of the United Nations Convention on the Law of the Sea, 1982 and theoretical basis of penal jurisdiction under international law. In addition, the study proposes a idea to the possibility of expansion of penal jurisdiction through examining legal questions arising from the M/V Earnest Hemingway Case in the Prosecutors’ Office and the Court.
Through this study, it emphasizes that the penal jurisdiction needs to be exercised actively to protect the Korean people and sovereignty.
