HFT 등 알고리즘거래에 대한 각국의 규제동향과 해결과제에 관한 비교법적 고찰 (A Comparative Study on Regulation Trends and Problems of Algorithm Trading such as HFT)

초록

비록 주요 선진국의 자본시장을 중심으로 존재감이 크게 높아진 HFT 등 알고리즘거래의 실체가 여전히 분명하지 않은 것은 사실이다. 하지만, 알고리즘을 이용한 HFT거래기법이 불공정할 가능성이 있다는 이유만으로 활용을 주저하는 것은 옳지 않다. 이들 알고리즘을 이용한 거래를 둘러싼 불공정성 논란이 앞으로도 끊이지 않는다면 결국 자본시장의 발전을 저해할 수 있으므로, 이러한 의혹을 해소하고 해결방안을 모색하는 것이 한국 자본시장의 발전을 위해서도 반드시 필요한 검토라고 본다. 시장거래의 투명성을 높여서 다양한 투자자가 안심하고 참가할 수 있는 건전한 시장을 실현하기 위해서는 이러한 불신감을 극복해야 하기에, 본고에서는 투자자에게 신뢰받는 시장이 구축되는데 필요한 규제개선의 방향성에 대하여 생각해보았다. 한국에서도 착오주문의 방지를 위한 제도를 도입하는 등 규제가 강화되었지만, 여전히 HFT와 관련된 효과적인 통제가 이루어진다고는 할 수 없으며, HFT와 관련된 연구도 충분하지 않은 상황이다. IT인프라 정비로 인하여 HFT를 이용한 매매환경이 조성되어 있는데, 미국, 유럽에 비하여 HFT에 대한 규제수준이 낮은 상황이다. 따라서 HFT의 비중이 높아지고 있는 현실을 고려할 때, HFT에 관한 연구가 보다 활발하게 이루어질 필요가 있다. 미국, 유럽 등에서 HFT에 대해 규제를 정비하고 있는 배경에는 그에 관련된 실증연구가 있었다. HFT와 관련된 실증연구가 있었기에 제도정비가 가능하고 개선의 당위성이 확보되었을 것이다. HFT와 관련된 주요 국가들의 규제상황을 보면, 어느 곳에도 고빈도에 초점을 둔 고속거래화를 제어하려는 움직임은 없고, 고속화의 시대흐름에 역행하는 규제방향은 바람직하지 않다는 것이 공통인식으로 보인다. 그리고 각국의 규제의 공통된 내용은 HFT업자에 대한 규제로서의 등록제도의 정비와 거래정보에 대한 보고제도의 충실화를 도모하고 있다는 점이다. HFT와 관련하여 금융당국이 취해야 할 태도로서는 시장에 해악을 끼칠 수 있는 사악한 존재를 배제한다는 접근보다는 시장이 안고 있는 문제점을 해결한다는 인식하에 관련규제의 강화 내지는 보완에 중점을 두려는 자세가 바람직하지 않을까 생각한다.

영어초록

It is true that the reality of algorithmic transactions such as HFT, whose presence has greatly increased mainly in the capital markets of major developed countries, is still unclear. However, it is not appropriate to hesitate to use the HFT method because it is likely that the algorithm is unfair. If the controversy over the unfairness surrounding the transaction using these algorithms is not stopped in the future, it will hinder the development of the capital market. Therefore, it is necessary for the development of the Korean capital market to resolve these doubts and seek solutions. In order to realize a sound market where various investors can participate safely by enhancing the transparency of market transactions, it is necessary to overcome such disbelief. In this article, we have considered the direction of regulation improvement necessary for establishing a trustworthy market for investors. In Korea, regulations have been strengthened, for example, by introducing a system to prevent misunderstandings. However, there is still no effective control related to HFT, and studies related to HFT are not enough. Due to the improvement of the IT infrastructure, the trading environment using HFT is being created, and the regulation level of HFT is lower than the US and Europe. Therefore, considering the fact that the proportion of HFT is increasing, research on HFT needs to be done more actively. In the United States, Europe, etc., there is an empirical study related to the regulation of HFT. Since there were some empirical studies related to HFT, the system could be improved and the justification for improvement was secured. Regarding the regulatory situation of major countries related to HFT, there is no movement to control high-speed transactions focused on high frequencies anywhere, and it seems common sense that regulation direction against the current trend of speeding up is not desirable. The common content of the regulations of each country is to improve the registration system as a regulation for HFT supplier and to improve the reporting system of transaction information. The attitude that financial authorities should take with regard to HFT is to focus on strengthening or supplementing related regulations with the recognition that it solves the problem that the market is facing rather than approaching to eliminate the evil existence that might harm the market.
