토지공개념 논의에 따른 주택분야의 입법정책 제언 (Legislative policy proposal for housing sector based on the public concept of land)

초록

토지공개념은 토지의 특수성에 기초하여 토지재산권에 대해서는 공공성⋅의무성⋅사회성을 그 자체의 본래적인 속성으로 인식하여야 한다는 기본 철학을말하며, 현행 헌법 제122조 및 제23조에 근거를 두고 있다.
오늘날 지가는 안정세에 접어든 반면, 주택의 상승률은 급등하고 있기 때문에 정부의 부동산정책은 주택 중심으로 이루어지고 있다. 주택의 투기수요 증가로 인한 주택시장의 불안은 사회경제적 부담으로 작용한다. 이에 정부는 토지공개념 철학을 원용하여 종합부동산세, 재건축 초과이익 환수 등과 같은 주택 중심의 강력한 규제 정책을 시행하고 있다. 그럼에도 좀처럼 주택 가격을안정시키지 못하고 있다. 서울의 아파트 가격은 다시 상승하고 있으며, 재건축초과이익 환수제와 관련하여 일부 재건축단지를 중심으로 헌법소원을 제기하는 등 상황은 더욱 복잡해지는 양상이다.
이러한 상황에서 문재인 대통령은 토지공개념을 강화하는 내용의 헌법개정안을 발의하였는데, 토지공개념에 주택을 포함할 수 있는지 여부 즉, 주택공개념 도입 가능성에 대한 판단이 매우 중요하다고 할 것이다.
그런데 주택은 재화의 속성상 토지에 고착되어 있을 뿐 토지의 특성을 직접적으로 대입하기에는 무리가 있다. 또한, 주택은 토지와 달리 인간의 주거와직접적인 관련성을 가지는 공간이며 강한 사적 영역으로 이해되고 있다. 이렇듯 현재로서는 주택공개념의 도입은 관념적, 사회⋅경제적, 법리적 측면에서한계가 있다. 토지공개념 확대⋅도입에 있어서 가장 중요한 것은 토지공개념의도입⋅확대의 필요성에 대한 국민적 합의를 도출하는 것이다.
따라서 (가칭) 부동산공개념연구위원회 내지 주택공개념연구위원회를 구성하여 토지공개념에 대한 정치(精緻)하고 세밀한 법적 연구가 이루어져야 한다.
나아가 다양한 계층의 의견을 수렴할 필요가 있다. 이러한 일련의 절차를 거친후에 토지공개념을 강화하는 내용의 헌법개정안을 마련하여야 할 것이다.
또한, 토지공개념에 주택을 포함하는데 있어 필요한 입법 정책 방향은 우선토지공개념에 주택을 포함하는 주택공개념이 국민적 합의를 거쳐 헌법에 수용되기 전까지는 국민의 신뢰보호를 위하여 종합부동산세를 강화하는 방향은 지양(止揚)되어야 한다. 그리고 「재건축 초과이익 환수에 관한 법률」은 과거 「토지초과이득세법」상 토지초과이득세의 양도소득세와의 이중과세 문제, 「종합부동산세법」상 미실현 이득에 대한 과세 및 원본잠식의 문제는 없는지를 판단하여야 한다. 마지막으로 주택공개념과 궤를 같이 할 수 있는 주택법제의 체계화가 이루어져야 할 것이다.

영어초록

The public concept of land refers to the basic philosophy that the public,obligation and social nature of land property should be recognized as its owninherent properties based on the special nature of land, Article 122 and 23 of thecurrent Constitution.
The government’s real estate policy is centered on housing as land prices arestable today, while housing growth is soaring. The instability of the housing marketdue to increased speculative demand on housing is a social and economic burden. Inresponse, the government implemented strong regulations centered on housing such asthe comprehensive real estate holding tax and the recapture of excess rebuilding gainsby invoking the public concept of land. Nevertheless, housing prices have not beenstabilized. Apartment prices in Seoul are rising again, constitutional complaints beinstituted by some reconstruction complexes about recapture of excess rebuildinggains, the situation seems to be getting more complicated.
In this situation, President Moon Jae-in introduced the constitutional amendment tostrengthen the public concept of land, and it is very important to judge whether ornot the house can be included in the public concept of land.
However, due to the nature of the goods, housing is attached on land, but it isdifficult to directly introduce the characteristics of the land. Also, unlike land,housing is a space that has a direct connection with human housing and isunderstood to be a strong private area. As of now, the public concept of housing islimited in terms of ideological, social⋅economic and legal aspects. The most important thing for the expansion or introduction of the public concept of land is todraw national consensus.
Therefore, the committee for the public real estate research should be formed toestablish a political and detailed legal study on the public concept of land.
Furthermore, it is necessary to collect opinions from various classes. After a series ofsuch procedures, a constitutional amendment should be prepared to strengthen thepublic concept of land.
In addition, the legislative policy direction needed to include housing in the publicconcept of land should not be implemented to enhanced comprehensive real estateholding tax until the public concept of land, including housing, is adopted throughnational consensus. And Recapture of excess rebuilding gains should be resolvedproblems of dual taxation under land excess-profits tax and taxation on non-realizedgains under the comprehensive real estate holding tax. Finally, it is necessary tosystemize the housing act system which can be combined with the public concept ofland.
