불법·비보고·비규제 어업(IUU 어업)의 개념 정의 - 법과 정치의 관계를 중심으로 - (Definition of Illegal, Unreported and Unregulated Fishing (IUU Fishing))

초록

불법, 비보고, 비규제 어업(‘IUU 어업’) 개념은 사회적, 정치적, 도덕적으로 ‘나쁘다’고 인식되던 모든 어업활동을 한꺼번에 비난할 목적으로 만들어졌으며, 이후 그대로 법적 개념으로 수용되었다. 본 글에서는 IPOA-IUU라는 연성법 문서에서 시작된 IUU 어업 개념이 큰 변형 없이 경성법의 영역으로 침투하면서 발생하는 문제점들을 살펴보았다.
현재 국제법상 IUU 어업 개념은 사실 ‘불법 어업 + 비규제 어업’을 합친 용어이다. 불법 어업이 연안국의 관할 수역 또는 지역수산기구 관할 수역을 공간적 범위로 한다면, 비규제 어업은 연안국 관할 수역 이원 수역에서의 행위만을 지칭한다. 문제는 굉장히 광범위한 어업활동들이 모두 IUU 어업 개념에 속한다는 점이다. 생물자원 보존, 관리 강화라는 정책적 측면에서 보자면, 이에 대하여 긍정적인 평가를 내릴 수도 있을 것이다. 그러나 이러한 정치적 의도로 인하여 현재 IUU 어업 개념 일부는 법적 개념으로서 이해하기 어려운 특성을 갖고 있다. 불법, 비보고, 비규제 어업 내용 간 중복, 그로 인한 불필요한 반복, 그리고 명확성의 결여 등이 개념 정의의 주요 문제였다. 특히 비규제 어업 개념은 어업활동이 불법 아닌데 불법처럼 규제 대상이 되는 모순을 야기한다.
본 글은 IUU 어업으로 인한 해양 생태계 파괴를 막아야 한다는 사회적 당위론이 ‘IUU 어업’이 법 개념으로서 가져야 할 규범적 특성을 약화시키고 있음을 확인하였다. 그리고 국제수산규범 형성에서 국제적 필요를 달성하기 위한 협력과 ‘peer pressure’가 중요한 변수로 작용한다는 결과를 도출하였다. 마지막으로 국제수산규범의 적용 범위가 실정법의 영역에서 정치적, 도덕적으로 필요한 영역까지 확대되고 있음을 확인하였다.

영어초록

The concept of illegal, unreported and unregulated fishing (IUU fishing) was created in order to blame all fishing activities that are socially, politically and morally considered ‘bad’. This concept has developed into a legal notion as it has been repeatedly used in legally binding international/regional instruments. This paper aims to analyze legal issues raised in the course of incorporating the definition of IUU　fishing under a soft law document (IPOA-IUU) into hard law instruments.
This paper reveals that IUU fishing under current international law is categorized only as ‘illegal fishing and unregulated fishing’. Illegal fishing comprises fishing activities carried out in waters of the coastal state or in those under jurisdiction of regional fisheries management organizations. On the other hand, unregulated fishing refers to fishing activities which are carried out beyond national jurisdiction of the coastal state. One of primary criticisms to the notion of IUU fishing is that the concept of fishing is too ambiguous to articulate its meaning precisely in the legal context. Although this kind of ambiguity could be encouraged in the perspective of eco-friendly policy, it could be said that this concept is just a expression of a certain policy goal which is driven by political intentions. This politically motivated conceptualization has a risk of making the concept of IUU fishing open to various criticisms raised in the legal perspective. Current notion of IUU fishing is criticised to have many different kinds of drawbacks: for example, overlap between illegal, unreported and unregulated fishing, unnecessary repetition of same contents and lack of precision. This paper also underlines a contradiction in the definition of unregulated fishing: non-illegal activities are legally regulated as if they were illegal.
Consequently, this paper points out that the social necessity to protect marine eco-system from IUU fishing has a tendency to weaken normative characteristics that IUU fishing as a legal notion is required to have. Furthermore, this paper finds that non-legal factors such as the call to cooperation for international necessity or peer pressure play considerably important roles in promoting international law-making and legal conceptualization. Finally, this paper argues that applicable scope of international fisheries law extends from the ambit of positive law to the ambit which is politically and morally necessary to regulate.
