초록

2008년 「자격기본법」에 민간자격 관리를 위한 등록제가 도입된 이후 등록 민간자격의 수는 급격히 증가하고 있고, 등록된 민간자격으로 인한 폐단도 증가하는 추세이다. 정부는 민간자격의 폐해를 해소하기 위하여 민간자격등록에 대한 여러 가지 제도 개편을 추진하고 있으나, 근본적으로 민간자격 등록제의 실효성이나 정당성에 대해서는 여전히 의문이 제기될 수 있는 상황이다. 민간자격으로 인한 소비자의 피해를 최소화하기 위한 장치로서 등록제를 도입한 것이 타당한지에 대한 문제를 논외로 하더라도, 현행 민간자격 등록제는 등록요건 등을 비롯 여러 제도적 장치가 다른 등록제와 비교할 때 등록제의 기능을 하는 데 부족하게 입법되어 있기 때문이다. 이는 앞으로 민간자격 등록이 지속적으로 증가하는 상황에서 민간자격 등록제 운영과 관련된 법적 분쟁을 증가시킬 것으로 예상된다.
아직까지 민간자격 등록에 대한 법적 분쟁은 거의 없었다고 할 수 있다. 그러나 최근 들어 민간자격 등록요건 중 하나인 “다른 법령에서 금지하는 행위와 관련된 분야”에 대한 해석에 관한 소송과 법제처의 법령해석사례가 나오고 있고, 법원과 법제처의 해석의 방향이나 결과도 상이하게 나타나는 상황이라는 점에서도 논의의 필요성이 있다. 특히 민간자격등록제도에 대한 해석상의 문제들이 나타나는 이유가 일정부분 입법적 문제점에서 비롯된다는 점에서 민간자격 등록요건인 “다른 법령에서 금지하는 행위와 관련된 분야”에 대한 검토를 통하여 민간자격 등록제도의 입법적인 해결방안의 마련도 필요하다. 본 논문에서는 민간자격 등록이 거부되는 제한사유를 넓게 해석하는 것은 민간자격등록제의 도입취지에 부합하지 않으며, 과잉적인 제한이 될 수 있다는 것을 비판적으로 지적하였다. 또한 이러한 해석의 원인이 현행 「자격기본법」에 도입된 민간자격 등록제도의 문제점에 있는 만큼 민간자격 등록제를 폐지하는 것을 검토할 필요가 있다고 하였다. 현실적으로 등록제의 폐지가 어렵거나 유지의 필요성이 인정된다면 최소한 관련규정을 재정비하여야만 한다는 방안을 제시하였다.

영어초록

In 2008 a registration system was introduced in the 「Framework Act on Qualifications」 for the management of private qualification. Following its introduction, there was a rapid increase in the number of registered private qualifications, and also an increase in the harmful effects of registered private qualifications. In order to provide solutions for the harmful effects of private qualification the government implemented various policy reforms, however fundamentally the issue lies with the questions raised on the effectiveness and legitimacy of the registration system for private qualification. Even if the issue of whether it is appropriate to implement the registration system as a safety net to minimize consumer damage from private qualification is considered as irrelevant, the requirements for registration and other institutional strategies in the current registration system for private qualification, when compared to other registration system, can be seen as inadequate to implement the function of a registration system. Under such circumstances where there is a continuous increase in private qualification registration, it is expected that legal dispute related to the administration of private qualification registration system will also increase.
Up until now, it can be said that there have been very few legal disputes regarding requirements for registration of private qualification. However, there is also a need for discussion in that there have been lawsuits and case studies by the Ministry of Government Legislation regarding the interpretation of one of the requirements for registration “fields related to acts prohibited by other laws”, and that the direction and outcome of interpretation by the court and the ministry are different. In particular, as the reasons for interpretive problems of the private qualification registration system can been viewed as due to partially a legislative problem, the examination of the requirements for registration of private qualification “fields related to acts prohibited by other laws” in order to establish a legislative solution is deemed necessary. In this paper, In this paper, it was critically pointed out that the broad interpretation of the reasons for restricting private qualification registration does not conform to the purpose of introducing the private qualification registration system and may be an excessive restriction. It was also said that it was necessary to consider abolishing the private qualification registration system as the cause of this interpretation lies in the problem of the private qualification registration system introduced under the 「Framework Act on Qualifications」. In reality, if the abolition of the registration system is difficult or the need for maintenance is recognized, the relevant regulations should be reorganized at least.
