초록

헌법 제31조 제1항에서 명시하고 있는 “능력에 따라 균등하게” 교육을 받을 권리는 그 성격과 내용에 있어 다의적인 해석이 가능하다. 그런데 교육을 받을 권리는 개인의 인간다운 삶의 실현과 직업의 선택 및 민주시민으로서의 소양의 배양에 있어 전제가 되는데, 이러한 것들은 사회환경의 변화와 시대 상황의 변화에 따라 유연한 해석과 적용이 요청된다. 교육을 받을 권리는 국민에게는 각 개인이 생활영역에서 개성을 신장하고 직업 활동에 필요한 각종 능력과 자격을 함양하며 민주시민으로서의 자질을 갖출 수 있게 하는 수단이 되며, 국가에게는 교육영역에서의 실질적인 평등 실현을 통한 사회국가의 수립과 헌법이 지향하는 문화국가 실현을 위한 중요한 수단이 된다. 따라서 양자의 종합적이고 복합적인 목적 달성을 위한 세부적이고 구체적인 교육정책 및 제도의 수립과 정립이 요구 된다. 균등하게 교육을 “받을 권리”의 보장은 최종적으로 국가와 지방자치단체의 자세에 달려있다고 하겠다. 즉, 국가와 지방자치단체가 어떻게 학습자가 평등한 교육을 받을 수 있도록 지역 간의 교원 수급이나 교육재정의 확보 등 교육 여건 격차를 최소화하는 시책을 마련하고 시행하느냐에 따라 달라진다고 하겠다. 국가는 학생의 능력에 따라 균등한 교육을 받을 권리의 실질적인 보장을 위하여 교육시설 및 교육여건 개선을 위한 시책을 수립·시행함에 있어 지방자치단체와 협의할 필요가 있다. 학령인구의 감소와 지역격차의 발생에 따른 교육격차의 해소가 능력에 따른 균등한 교육을 받을 권리의 실질적인 보장을 위한 전제가 되므로, 국가는 이를 위한 노력을 경주할 필요가 있다.

Reinterpretation of the right to receive education “equally according to ability” on the Article 31 Paragraph 1 of the Korea Constitution * Professor of Law/Kunsan National University Ki-Ho NOH* Article 31 Paragraph 1 of the current Constitution stipulates the right to receive education “equally according to ability” as a basic principle regarding education. The right to equal education refers to the right of the state to guarantee that all citizens can receive equal education according to their abilities. “Ability” here means materials suitable for receiving education, and “equally” means that the right to receive education cannot be discriminated against based on race, gender, religion, or economic power.
However, the right to receive education “equally according to ability” in Article 31 Paragraph 1 of the Constitution requires a new interpretation and establishment of policies according to changes in social structure and times. For the people, the right to receive education is a means by which each individual can develop individuality in the field of life, cultivate various abilities and qualifications necessary for vocational activities, and be equipped with the qualifications as a democratic citizen. It is an important means for the establishment of a social state through Therefore, it is required to establish and establish detailed and specific educational policies and systems to achieve the comprehensive and complex goals of both.
On the other hand, the guarantee of the right to receive education equally according to ability ultimately depends on the attitude of the state and local governments. In other words, it will depend on how the state and local governments prepare and implement policies to minimize the gap in educational conditions, such as supply and demand for teachers or securing educational finances between regions so that learners can receive an equal education.
The state needs to consult with local governments in establishing and implementing policies to improve educational facilities and educational conditions in order to effectively guarantee the right to receive equal education according to students' abilities. Since the reduction of the school-age population and the resolution of the educational gap due to the occurrence of regional disparities are prerequisites for the practical guarantee of the right to receive an equal education according to ability, the state needs to make efforts for this.
