공통적인 것과 공적･사적 소유 (The Common and Public･Private Ownership)

초록

원자적 개인은 도그마로 주어진 말을 사용한다. 원자적 개인은 말의 제도화로서 법의 원천인 국가의 시민이 된다. 국가의 법은 공통적인 것에 대한 소유권의 근거가 된다. (디지털) 비물질적인 생산물은 사회적 협력의 생산물이다. 이 생산물은 말･이성･법으로 연결된 생산자의 신체이고, 공통적인 것이다. 그러나 국가는 공통적인 것의 사적 소유를 법적으로 강제한다. 자본가는 공통적인 것을 소유권을 통해서 착취할 수 있다.
랑시에르는 (디지털) 비물질적인 생산물을 공통적인 것이 아니라 사적 소유라고 말한다. 그러나 그는 공통적인 것의 사적 소유와 법 앞에 평등이 국가의 법에 기입되어있다고 말한다. 이런 의미에서 국가의 법은 자본가들을 위한 지배 장치와 동시에 노동자들의 평등을 위한 해방의 장치이다. 이 경우에 공통적인 것은 사적 소유의 전제가 된다. 그러므로 그는 공적･사적 소유의 전제로서 공통적인 것의 평등을 보지 못하고 있다.
네그리와 하트는 공통적인 것으로 국가의 법을 자본가들을 위한 지배 장치이고, 공통적인 것을 전제가 아니라 목적으로 생각하고 있다. 그들은 목적으로서 공통적인 것이 자본주의적 사적 소유의 대안이라고 말한다.
(디지털) 비물질적인 생산물, 말, 법은 공통적인 것이다. 이런 점에서 지성의 평등, 법 앞에 평등, (디지털) 비물질적인 생산물은 자본가와 노동자의 불평등을 해소하기 위한 목적이 아니라 전제이다. 사적･공적 소유와 공통적인 것을 나누기 위해서 말과 법 앞에 평등이 전제되고 있다.
네그리와 하트, 랑시에르는 (디지털) 비물질적인 생산물, 말, 법이 사회적 협력의 생산물이고, 공통적인 것임을 인식하지 못하고 있다. (디지털) 비물질적인 생산물, 말, 법은 공통적인 것이다. 말, 법, (디지털) 비물질적인 생산물은 공리적으로 평등을 전제하고 있다. 이 조건에서 원자적 개인은 국가와 연대하는 공통적인 것의 자치 공동체를 구성할 수 있을 것이다.

영어초록

An atomic individual uses the words given as a dogma. The atomic individual becomes a citizen of the state, which is the source of the law as the institutionalization of words. State law is the basis for ownership of the common. (Digital) Immaterial products are the products of social cooperation. This product is the body of a producer connected by words, reason, and law, and is the common. However, the state legally enforces private ownership of the common. Capitalists can exploit the common through ownership.
Rancière says that (digital) immaterial products are not the common, but private ownership. But he says that private ownership of the common and equality before the law are written in the laws of the state. In this sense, the state law is a governing device for capitalists, and also a device for liberation for workers’ equality. What is the common in this case is the premise of private ownership. Therefore, he does not see the equality of the common as the premise of public and private ownership.
Negri and Hart think of the law of the state which is the common, as the governing device for the capitalists, and consider the common as a purpose, not a premise. They say that the common, as a purpose is an alternative to capitalist private ownership.
(digital) Immaterial products, words, and laws are the common. In this respect, equality of intellect, equality before the law, and (digital) immaterial products are not the goal of resolving the inequality between capitalists and workers, but the premise. Words and equality before the law are presupposed to separate private and public ownership from the common.
Negri and Hart, Rancière fail to recognize that (digital) immaterial products, words, and laws are products of social cooperation, and are the common. (digital) immaterial products, words, and laws are the common. Words, laws, and (digital) immaterial products axiomatically presuppose equality. Under these conditions, the atomic individual would be able to form an autonomous community of the common in solidarity with the state.
