초록

디지털화되어 인터넷을 통하여 유통되는 정보는 그 복제가 손쉬울 뿐만 아니라 종래
의 아날로그 복제와는 달리 복제에 따른 품질의 저하가 거의 없고 복제된 정보의 유통
또한 광범위하고 신속하게 이루어질 수 있게 되었다.
저작권자들은 정보통신 기술이 초래한 이와 같은 환경의 변화에 대응하기 위하여 소
극적으로 저작물을 불법적으로 복제하는 행위를 방지하고 복제 행위자를 추적할 수 있
는 다양한 기술적인 수단을 저작물에 포함시키는 방법을 강구하게 되었다.
나아가, 저작권자나 저작물 유통업자들은 단순이 저작물의 불법적인 이용을 차단할
뿐만 아니라 나아가 적극적으로 인터넷과 같은 광대역 통신망을 이용한 저작물의 합법
적인 유통과 이용을 보장하는 기술을 개발함으로써 디지털 콘텐츠의 이용활성화를 도
모하게 되었다. 이와 같은 필요성에 의하여 디지털 저작물의 유통과 합법적 이용을 보
장해 주는 기술적 수단으로서 등장한 것이 이른바 디지털저작권관리 시스템, 즉
DRM(Digital Rights Management)이다.
DRM은 이와 같이 저작권의 보호뿐만 아니라 디지털 저작물의 유통 활성화를 위해
탄생한 것이므로 필연적으로 저작물의 유통과 이용을 통제하는 기술이 내재되어 있다.
따라서 저작물의 이용을 위한 기술적인 수단, 즉 각종 디바이스나 실행 프로그램과의
호환성이 결여되는 경우 디바이스 시장에서의 시장지배력이 저작물 유통시장으로 전이
될 수 있어 공정거래를 해칠 수 있다는 주장이 제기되고 있다. 특히 프랑스와 우리나라
의 공정거래 당국은 이와 같은 전제에서 디바이스 시장에서의 시장지배적 사업자에 의
한 폐쇄적 DRM 사용에 대하여 이를 금지하고 상호운용성이 보장된 DRM사용을 강제하
려고 시도하였으나 결국 법원에 의하여 실패로 돌아갔다.
장기적으로는 온라인 음악시장의 발전과 다양성 확보를 위해서는 DRM을 표준화하
거나 상호운용성을 확보하여 온라인 음악시장이 다양화 되고 순수한 음악 시장에서의
품질에 따른 공정한 경쟁이 보장되도록 할 필요는 있다.
그러나, DRM은 불법이용으로부터 콘텐츠를 보호하기 위하여 저작권법에 의하여 보
호받는 그리고 권장되는 기술적 수단인 동시에 디지털 콘텐츠 유통과 관련한 중요한
비즈니스 모델의 성격도 갖고 있다는 점에서 그 표준화나 상호운용성을 쉽사리 법률로
강제하는 것에는 신중을 기하여야 한다. 오히려 기업들간의 자율적인 협의를 통한 표준
화나 상호운용성 확보를 유도하는 것이 정책적으로 바람직하다.

영어초록

Digitalized information distributed through the Internet is not only easy to
copy, but unlike analogue information, there is little deterioration in quality and
the distribution of copied information takes place rapidly and on a large scale. In
order to respond to such changes in circumstances caused by the development of
information and communications technologies, copyright holders have passively
searched for ways to include various technical measures in copyrighted materials to
prevent the illegal copying of products and to trace those who infringe copyright.
Moreover, copyright owners and distributors moved beyond simply blocking illegal
usage of copyrighted products, and made active efforts to develop technologies
that assure legal usage and legal distributions of copyrighted products using
broadband communication networks such as the Internet, thereby promoting the
usage of digital contents. The digital copyrights management system, which was
created, based on such needs as a technical measure to secure the legal usage of
digital contents is what we refer to as the DRM(Digital Rights Management).
However, as the DRM was created not just to protect copyrights, but also to
promote the legal distribution of copyrighted digital contents, it necessarily
includes technologies that control the legal distribution and use of copyrighted
contents. Thus some are contending that when inter-operability with technical
measures for using the copyrighted contents, i.e., various devices and executing

programs is lacking, the market power of the device market can be shifted to the
digital contents distribution market, thereby impairing fair trade practices. In the
case of our country and France, the government authorities in charge of fair trade
accepted this as a given premise and efforts were made to prohibit the usage of
closed DRM by businesses that have dominant market power of the device market
and to enforce the use of inter-operable DRM, but were struck down by the
courts. Of course, in order for the online music market to grow and have variety
in the long term, DRM systems must be standardized and their inter-operability
must be secured so that the online music market becomes multifaceted and fair
competition in the actual music market is assured. However, with regards to the
fact that DRM systems are not only technical tools promoted and recommended
by copyright laws in order to protect contents from being infringed, but also
possess the properties of an important digital contents distribution related business
model, caution must be exercised in using the law to forcefully standardize them
or establish inter-operability. In terms of policy, inducing voluntary agreements
between corporations for the standardization and inter-operability of DRM systems
is the more desirable road.
