재외선거의 정치적, 입법적 과제 (The Political and Legal Problems of Overseas Voting System)

초록

재외국민에게 정치적 권리(투표권)를 부여하는 재외선거제도의 도입을 계기로 국민주권의 실천형태에 대한 새로운 시각과 담론을 형성할 필요가 있다. 재외선거는 국외에 거주하는 유권자에게 주어지는 정치참여의 통로이자 국민주권의 확장이다. 선거에서 신분의 차별․재력의 차별․인종의 차별․성의 차별이 해소되면서 민주시민의 정치참여가 활발해지고 대의민주주의가 발전하였듯이, 이제 거주의 차별이 해소됨에 따라 국외에 거주하는 유권자의 정치참여가 활발해지고 한국의 대의민주주의도 달라질 것이다.
그러나 국내 선거에 영향력이 예상되는 재외선거가 국외에서 치러지는 만큼 준비나 절차상에서 참여를 제약하는 요인이 있고 공정성에 문제가 발생할 수 있다. 이에 참여의 규모와 공정성 문제가 전체 선거의 유효, 무효 여부에 영향을 미칠 수 있고 나아가 선거결과에서 불이익을 받는 정당이 제도 자체의 폐지까지 주장하는 상황을 예상해 볼 수 있다.
재외선거제도에서 참여와 공정성 문제는 기존의 국민주권을 수정없이 재외국민에게 단순한 확대적용으로 해결될 문제가 아니다. 대한민국 선거사를 일별하면 능동적인 참여와 공정성이 확보되기까지는 입법․행정․사법기관의 국가작용도 있었지만 이보다도 ‘깨어있는 시민들’의 노력과 희생이 보다 본질적이었다.
재외선거 현장의 주체인 재외국민이 ‘주어진’ 재외선거제도에 수동적으로 대응하거나 심지어 부정적으로 변질될 때, 재외선거는 재외국민의 권익신장 창구로서, 대한민국 주권의 영역확대에 따른 국력증진 수단으로서의 취지 퇴색은 물론 대한민국 정치의 새로운 골치덩어리로 전락하고 말 것이다. 그러나 재외선거에 대한 재외유권자의 의식과 태도를 분석한 결과 재외국민에게 국내에서 시행되고 있는 민주시민으로서 정치교육을 충분히 받게 한다면 재외선거를 계기로 동포사회의 시민사회로의 전환과 자발적인 공명선거운동의 자정능력을 기대하게 하였다.
중앙선거관리위원회 조직 중 선거연수원의 업무와 지위를 격상시켜서 국민의 정치교육 관장기관으로 만들되 학계 및 전문가와 각종 시민단체와 연대하여 가치중립적으로 운영할 필요가 있다. 중앙선거관리위원회가 명실공히 국내에 거주하는 국민과 재외국민에게 제공될 민주시민교육의 주체가 될 때 비로소 재외국민의 자율적 민주시민교육시스템도 상정할 수 있다.

영어초록

The overseas voting system should be maintained and developed further as a channel of political participation by Koreans in other countries, to contribute to the development of electoral democracy. To this end, it is imperative that methods of assuring sufficient voter participation and fair management of elections be put into place and studies be conducted to find ways to maintain a positive and stable role of the overseas election system. While the issues of ensuring adequate participation and fairness cannot be addressed by a simplistic application of popular sovereignty doctrine, there is certainly an implication here of urgent legislative tasks which must be addressed.
In this respect, this research is a survey and an analysis of the consciousness and attitudes of Korean citizens living abroad on the topic of election participation and fair election management, from the perspective of the institutional theory of election that election systems affect voting behaviors.
It should be noted that in the end the rate of participation is largely determined by the basic attitude and consciousness of the voters regarding elections. To precisely understand these attitudes, the following questions were asked during our survey, which are related to the voters’ sense of obligation to vote; belief in the efficacy of overseas voting; consciousness of one’s sovereignty; intent to participate in the vote; reason for abstention where applicable and criteria of choosing a candidate:Fair election management is also largely dependent on the attitudes of voters about unfair elections, along with institutional and environmental factors. To understand the thoughts and attitudes of Korean overseas voters regarding fair elections, interviewers asked the following questions associated with the respondents’ perception of election wrongdoing, willingness to participate in the election process and activities, intended reactions when experiencing illegal campaign practices and awareness of the types of illegal campaign practices:To analyze the pending issues in the overseas election system, this study examined two areas, highlighting overseas Korean citizens’ preferences of voting methods and the preferred areas of suffrage extension.
Numerous initiatives are called for: first, a legislative revision bill already proposed at the National Assembly that would allow voting by mail and increase the number of voting places in foreign countries; second, legislative measures which were omitted in earlier legislative revisions made in response to the Constitutional Court’s 2007 ruling, to allow the application of overseas election to referendums and absentee voting for sailors. Additionally, institutional measures that need to be addressed as quickly as possible include the introduction of public management of election campaigns in overseas elections, the introduction of a semipermanent list of overseas voters and implementing educational programs for overseas elections.
Mid- to long-term legislative tasks would include granting voting rights to holders of dual nationalities, allocating seats in the National Assembly for overseas Korean communities (introduction of special overseas constituencies, parliamentarians of proportional representation systems representing overseas special districts) as a means to grant political representation rights to overseas Korean communities.
Ultimately, it is believed that overseas elections will not only grant suffrage to Korean citizens residing overseas, but also function as a channel of education for democratic citizenship. It is also hoped that such learning will contribute to the development of Koreans overseas to play a leading role in their local societies and gain recognition so that, as is the case of the people of Israel, they can play a significant role in the security and economic prosperity of their homeland.
