초록

개방화시대를 맞이하여 국경은 무너지고 범죄는 세계화되면서 우리 교정은 외국인범죄의 위협 앞에 큰 과제를 떠안게 되었다. 비록 외국인 수용자의 구성비는 전체수용자의 2%에도 미치지 못하지만 매년 20-40%씩 증가하고 있는 실정이다. 교정당국은 외국인재소자에 대한수용관리를 효율적으로 수행하기 위해 교정처우만족도 향상을 위한 다양한 프로그램을 발 빠르게 강구하고 있는 실정이다. 그러나 살인, 강도, 약물남용범죄, 폭력집단범죄, 전화사기 등 최근의 범죄동향의 특징과 맞물리면서 우리의 교정행정은 새로운 위기에 직면해 있다. 향후 외국인 150만 명에 육박하는 시대에 외국인범죄는 현재보다 더 큰 폭으로 증가할 것이 예상되는 바 외국인재소자의 교정처우만족도 향상에 있어 우리 교정당국이 안고 있는 현재의 문제 상황과 나아갈 방향이 무엇인지를 짚어보고 다문화시대의 교정처우만족도를 높일 수 있는 방안을 제시해야 할 것이다. 이 연구에서는 외국인재소자에 대한 교정처우 만족도 향상 프로그램을 실행하여 수용생활만족도향상과 사회복귀기대감이라는 성과를 가져올 수 있는 방법을 모색하고자 하였다. 또한 향후 대한민국의 모든 교정시설의 외국인재소자 증가에 대비해서 법률과 제도를 정비하고 새로운 방안을 마련하여 외국인재소자에게 교정처우만족향상이라는 비젼을 제시하는 데 도움이 되는 기초자료를 제공하고자 한다.

영어초록

As frontier is collapsed and crime is globalized in the opening age, our correction has taken a large task against the big intimidation of foreign crime. Although the portion of foreign termer is below 2% of all termers, the portion is increasing by 20-40% each year.The correctional facility is promptly taking diverse programs to improve the satisfaction in correctional treatment in order to efficiently accommodate multi-cultural termer. However, our correctional administration faces new crisis owing to the recent trend of crime such as homicide, robbery, crime of drug abuse, collective violence, fraud by phone, etc.As foreign crime is expected to increase further in the age where population of foreigners approximate to 1.5 million, it is required to check present problem and direction of our correctional facility in improving the foreign termer's satisfaction in correctional treatment and to suggest how to enhance satisfaction in correctional treatment in the multi-cultural age.The issue of crime by foreigners has emerged as the number of illegal stayers increased with the legal entrance of industrial trainees in our society since 1993. It can be said that the increment of foreigners' crime is inevitable due to the increasing number of foreigners.The foreigners' crime caused many problems to the persons in trial & treatment of termer with considerable influence on the criminal jurisdiction of the state. Many problems occur not only in trial but in the execution.Such problems are derived from problems caused by cultural difference and institutional difference. Although efforts are made in the national & international level to solve these problems, such efforts are still insufficient in many aspects.To effectively manage foreign termers & protect their human right, Korea does not legally discriminate them from natives in all areas, considering「The minimum standard rule of treatment of confinee」of UN, taking basic principle to effectively treat them equally. However, the effort of more positive policy seems necessary to foreign termers in the multi-cultural age due to the change and request of the age.Performing questionnaire to foreign termers with this study with subject “A study on the multi-cultural termers' satisfaction in correctional treatment”, it was found that the independent variables of satisfaction in accommodation & expectation of return to society, namely, receptivity of multi-culture, satisfaction in communication and satisfaction in multi-cultural program have significant influence.Especially, satisfaction in multi-cultural program has higher satisfaction in correctional treatment than satisfaction in communication and receptivity of multi-culture. When it comes to legal inbound passenger & illegal stayers, the former's satisfaction in correctional treatment is higher than that of the latter. In conclusion, this study investigated the method to make the result of improving satisfaction in accommodation and expectation of return to society by performing program to improve multi-cultural termer's satisfaction in correctional treatment. Further, this study intends to provide basic data that helps presenting the vision of improvement of correctional treatment to multi-cultural termer by arranging law/system and preparing new program to cope with the increasing foreign termers in all correctional facilities of Korea.
